Johann Christoph Frölich was a 17th-century Austrian lawyer known for his studies in both criminal and feudal law. Perhaps his most well-known work was his “Commentary on Charles V Neck Order” – a treatise expounding on the Criminalis Carolina law procedure.
This book, a commentary on treatment of prisoners, offers descriptions on legal orders, investigation processes, rights given to prisoners, and his views against excessive use of torture. While Frölich did not call for the complete abandonment of torture (in order to find the truth), he did advocate to use it with a ‘human mind’. In fact, Frolich, who was consumed by the thought of witches and witchcraft existing in his time, instructed authorities who were using torture in their witch trials to use it cautiously so as not to “offend an innocent person”.
