A rare 16th-century first edition of Alvari Valasco’s “Quaestiones Juris” – a collection of fifty-one ‘questions’ with answers, discussions, and commentary. The discussions are chiefly based on Roman Law with attention to papal decrees, the “Libri Feudorum”, and statutory law in Portugal. Valasco also discusses the right to own land, property, and acquire agricultural funds – the idea that property and home improvement was important.
According to Zwierlein,
“Early modern commentators saw emphyteusis as a very robust right, and a few therefore felt the need to specify, as did the Portuguese jurist Alvaro Vaz, that it was ‘contrary to justice and equity’ for a prince to deprive the emphyteuta of his land without cause” (Zweirlein, 95)
